Bangladesh pacer Rubel exempted from rape charges

Police on Monday submitted the final report exempting cricketer Rubel Hossain from the charge of a case filed under the Women and Children Repression Prevention Act.
Capital’s Tejgaon Victim Support Centre Inspector Halima Khatun submitted the report to the Chief Metropolitan Magistrate (CMM) Court of Dhaka on Monday afternoon.Inspector Halima Khatun mentioned in her report that no evidence of rape by Rubel was found against the accused in the forensic report. “So we seek Rubel’s exemption from the charge”, she added.
A Dhaka court had earlier fixed April 13 to hearing on the probe report. Rubel’s lawyer Moniruzzaman said the cricketer would appear before the court on the fixed date and seek exemption from the charge.
Actress Happy filed the case against Rubel with Mirpur Model Police Station under the Women and Children Repression Prevention Act on December 1, last year.
According to Section 9(1) of the Prevention of Repression Against Women and Children Act 2000, whoever goes for sexual intercourse without lawful marriage with a woman by fraud, shall be said to have committed rape. It also says that anyone who commits the offence shall be punished with rigorous imprisonment for life and fine.
On December 31, a Dhaka court gave the permission to conduct the DNA test of Rubel Hossain in the case. Earlier, police collected some samples for DNA test from Rubel’s residence and sent to the laboratory of Criminal Investigation Department.
According to the FIR, Rubel wanted to marry Happy and had an affair that included physical relations for nine months. Happy, the heroine of “Kichhu Asha Kichhu Bhalobasa,” said they first met through friends and then stayed in touch through Facebook and mobile telephone.
The 24-year old Rubel made his debut in international cricket in 2009 and meanwhile appeared in 22 Tests, 53 ODIs and 11 Twenty20 internationals. – Court Correspondent
