A court of Dhaka on Sunday sentenced Helal Uddin, a former Officer-in-Charge (OC) of Khilgaon Police Station, to three years rigorous imprisonment (RI) in a case filed for torturing the then Dhaka University student Abdul Kader in police custody.
Md Alamgir Kabir Raj First Additional Chief Metropolitan Magistrate of Dhaka gave verdict on Sunday afternoon. The court also fined fugitive former police officer Helal Tk 10,000, in default, he will suffer three months more in prison. The punishment will begin from the date of his arrest or surrender to the court.Kader, a former student of biochemistry and molecular biology of Dhaka University, filed the case against on Jan 23, 2012 for torturing him after his arrest in 2011.
According to the details of the case, plainclothes police personnel arrested Kader on July 16, 2011 while he was returning to Fazlul Haque Hall of DU from one of his relatives’ house in Eskaton area of the capital.
Later, Kader joined Lakshmipur Government College as a teacher after qualifying in BCS (Education). Complainant Kadar’s lawyer Gaffar Hossain said the punishment Helal Uddin got was the maximum for the offence under the Section 324 of Bangladesh Penal Code.
Defence lawyer Saidur Rahman Manik said in the court that OC Helal Uddin could not attend the hearing as he was ill.
Magistrate Raz dismissed the issue as the counsel failed to show any document on the illness. He delivered the verdict taking Helal Uddin as a fugitive.
Kadar, now a teacher of Laxmipur Government Women’s College, has said he is happy with the judgment.
Police faced massive criticism after torturing in custody Kadar, then a student of biochemistry and molecular biology, in 2011.
He was arrested on July 16 that year on charges of carjacking. The charges were proven wrong in an investigation launched following a High Court order.
The High Court also ordered suspension of OC Uddin, a sub-inspector and an assistant sub-inspector for torturing Kadar.
Kadar filed the case against Helal Uddin on Jan 23, 2012.
According to the statement he gave in the court, police stopped him at Segun Bagicha when he was returning to Fazlul Haque Muslim Hall.
Plainclothesmen beat him in the leg with sticks and took him to Khilgaon Police Station, he said.
OC Helal Uddin beat and injured him to force a confession, he alleged.
Having failed to make him admit to the said crime he did not commit, the OC struck Kadar in the leg with a machete, he said. – – Court Correspondent
