Khaleda sued for celebrating fake birthday on 15 Aug

The Chief Metropolitan Magistrate (CMM) Court of Dhaka on Tuesday summoned BNP Chairperson Begum Khaleda Zia to appear before it in a case filed against her on the charge of celebrating `fake` birthday on the National Mourning Day of August 15.Magistrate Md Mazharul Islam of the CMM Court took cognizance of the case and asked Khaleda Zia to appear in person in his court on October 17.
Earlier, former Joint General Secretary of Dhaka Union of Journalists (DUJ), Gazi Jahirul Islam filed the case with the CMM Court accusing the BNP Chief Khaleda Zia of provoking people, celebrating her ‘false’ birthday on August 15. He lodged the case under sections 198 and 469 of the Penal code. The section 198 says, ‘Using as true a certificate known to be false- “Whoever corruptly uses or attempts to use any such certificate as a true certificate, knowing the same to be false in any material point, shall be punished in the same manner as if he gave false evidence.”
Again section 469 says, ‘Forgery for purpose of harming reputation’ “Whoever commits forgery, intending that the document forged shall harm the reputation of any party, or knowing that it is likely to be used for that purpose, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.”
Complainant Jahirul Islam has mentioned that Khaleda’s date of birth was mentioned August 5, 1946 in her latest passport while August 9, 1944 in her marriage registration document and September 5, 1946, in her SSC mark sheet. However she could not succeed in the examination. The complainant also said Khaleda’s biography was published in the ‘Dainik Banglar Bani’ in 1991 where her birth date was mentioned August 17, 1945.
The complainant also noted in the case statement that 15th August was declared National
Mourning Day in 1996 and Khaleda has started celebrating her birth day on this day, cutting cake since then and it is ridiculous.
Just to undermine Bangabandhu and hurt his family she selected this day for celebrating her ‘fake’ birthday and it is provocative, defamatory, disturbing and against the law of the land, he added.
Though Khaleda Zia had long been celebrating her birthday on August 15, cutting big cake, she refrained from doing that this year while her party only arranged a doa and millad mahfil on the occasion. BNP leaders said Begum Khaleda Zia decided not to cut any cake this year, as the country has been facing serious crisis and many flood victims have been experiencing immense sufferings.
Begum Khaleda was born in 1946, there are a many debates about her real date of birth including the birth year, the statement concluded. -Special Correspondent
