Legal notice on Govt for appointment of Chief Justice

Dhaka – A legal notice has been served asking the government to take necessary steps for appointing the Chief Justice of the country and more judges to the Appellate and High Court divisions of the Supreme Court within 72 hours.Eunus Ali Akond, a Supreme Court lawyer, on Sunday sent the notice to the respondents saying that he will file a writ petition with the High Court seeking necessary directives if they fail to appoint the Chief Justice and judges from the Supreme Court lawyers within the deadline.
The president appoints more than 80 percent judges of the High Court Division from the lawyers practising in the Supreme Court, Eunus said in his legal notice.
But, cent percent Appellate Division judges are appointed from among the High Court judges which is discriminatory and violation of principles of natural justice. Even in the constitution, there is no provision of promotion of High Court judges, he added in the notice.
The notice further says that in India, Pakistan and USA, the Supreme Court judges are appointed from among the lawyers.
The Law Secretary, Cabinet Secretary, President’s Secretary, Prime Minister’s Office Secretary, Registrar General of the Supreme Court and Chairman of the Bangladesh Bar Council have been made respondents in the legal notice. – Special Correspondent
