Magistrate, OC summoned for sentencing people in custody


Dhaka, 14 Jan – The High Court yesterday summoned four officials including Nirbahi magistrate and officer-in-charge (OC) of Lohagora police station of Chittagong district for sentencing a people even after staying under the police custody in connection with criminal case.In response to a writ petition, the HC bench comprising Justice Dastagir Hossain and Justice Ataur Rahman Khan asked them to appear before it on January 28 for explaining their position over the matter.
The HC bench also issued a rule asking the government to explain why the punishment given to Belal Uddin through mobile court should not be cancelled and why the government should not directed to take action against the responsible persons, who were involved in punishing Belal Uddin through mobile court.
It also asked the authorities concerned to explain why they should be directed to pay Tk 20 lakh as compensation to Belal Uddin.
Mahbub Alam, Upazilla Nirbahi Officer (UNO) of Lohagora, OC Md Shahjahan, SI Helal Khan and Wasim have to appear before the court on January 28 to explain their position over sentencing the people through mobile court.
The four official Belal Uddin were allegedly involved in setting up mobile court and sentencing Belal Uddin to eight month jail in connection with a criminal case even after he was stayed under police custody during the punishment.
The HC bench came up with the order and rule following a writ petition filed by Belal Uddin challenging the legality of his punishment given by mobile court.
According to the petition, police produced Belal Uddin before the Chittagong court on October 13 last year after arresting him.
But, it was mentioned in the mobile court verdict that Belal Uddin was arrested on October 12 along with 2 packets drug (gaza), which showed that mobile court awarded punishment to Belal Uddin while he was in police custody.
Belal filed the petition with the HC last week seeking its directive over the matter.
Advocate Manzill Murshid appeared before the court on behalf of the petitioner. – Staff Reporter
