Writ filed challenging recruitment of Election Commission

Dhaka, Nov 26 – A writ petition was filed on Sunday with the High Court challenging the legality of the appointment of the chief election commissioner and four other commissioners claiming that no specific rules were formulated for their appointment. The petition sought HC directive upon the government to cancel the appointment of the election commissioners including CEC Nurul Huda and to constitute a fresh election commission.
In the petition, he requested the HC to stay the process for holding the upcoming parliamentary election on December 30.
Supreme Court lawyer Advocate Delwar Hossain filed the writ with the related branch of the High Court yesterday morning.
The HC bench comprising Justice Moyeenul Islam Chowdhury and Justice Md Ashraful Kamal is likely to hear on the petition today.
The Chief Election Commissioner, four commissioners, law secretary and secretary to election commission secretariat have been made respondents in the petition.
It was mentioned in the petition that there is clear direction in the Article 118 of the Constitution about the formation of Election Commission but it was not followed during recruitment of the current CEC and the four commissioners.
The petition said that an election commissioner has to have experience of doing performance independently as per the constitution but the incumbent CEC has no past experience. As he was a bureaucrat and a government official, he did not perform any function independently.
And therefore, his appointment contradicts with the constitution, according to the petition. – Staff Reporter
