Dhaka, Nov 5 – The Chief Metropolitan Magistrate (CMM) Court of Dhaka on Monday rejected the bail petition, filed on behalf of former Caretaker Government adviser Barrister Mainul Hosein. Advocates Sanaullah Mia, Syed Joynul Abedin Mesba and a number of other lawyers conducted the hearing on behalf of Barrister Mainul Hosein.
They said whatever Barrister Mainul said, he told journalist Masuda Bhatti, nobody else. Moreover, he sincerely sought apology to MS Bhatti without any delay. They added Barrister Mainul did not tell complainant Sumona Akhter Lily anything. In the circumstances, how could Sumona Akhter lodge the case?
The case was filed under the bailable section of the Digital Security Act. The accused, former President of the Supreme Court Bar Association (SCBA) and also a senior lawyer of the country, has every right to get bail in this case.
On the other hand, Dhaka Metropolitan Public Prosecutor (PP) Abdullah Abu, Advocate Salma Hai and some other pro-Awami League lawyers vehemently opposed the bail of Barrister Mainul Hosein.
Metropolitan Magistrate Baki Billah passed the order after hearing both sides depositions in absence of Barrister Mainul Hosein. On November 1, Mainul was shown arrested in the case after Sub-Inspector Ziaul Haque made an appeal to the court.
Earlier on October 24, Sumona Akhter Lily, Awami League Youth and Sports sub-committee member, filed the case against Barrister Mainul Hosein with Cyber Tribunal (Bangladesh), Dhaka. After the hearing, the tribunal directed the officer-in-charge of Gulshan Police Station to register it as a regular case, which they did after getting the order.
Mainul Hosein is now facing 18 other cases. Mainul was arrested from the capital’s Uttara on October 22 in connection with a defamation case filed in Rangpur.
The following day, another Dhaka court sent him to the jail after rejecting his bail in the case filed in Rangpur.
On Saturday, Mainul was transferred to Rangpur Central Jail and on Sunday his bail was again rejected by Rangpur Chief Judicial Magistrate Court.
