Court asks for resubmission of Kibria murder chargesheet

A Habiganj court has ordered the resubmission of a supplementary charge sheet in former finance minister Shah AMS Kibria’s murder case, as the previous one got the names and addresses of several accused wrong.
The court of Senior Judicial Magistrate Rokeya Aktar on Wednesday ordered Sylhet’s Assistant Superintendent of Police Meherun Nesa Parul to submit a new chargesheet on Dec 21.
Parul, who was asked to investigate the case in 2012, had pleaded for time for correction and resubmission.Local BNP supporters had demonstrated in the court, alleging that Habiganj Municipal Mayor and the party’s district unit general secretary Golam Kibria Gaus had been falsely implicated as a part of a ‘conspiracy’.
The third supplementary charge sheet, submitted on Nov 13, had accused 35 people, including BNP chief Khaleda Zia’s former political secretary Harris Chowdhury and Sylhet Mayor Ariful Haq Chowdhury.
Shah AMS Kibria was fatally wounded in a grenade attack on Jan 27, 2005, on his way back from a rally in Habiganj Sadar. He died on the way to Dhaka.
His nephew Shah Monjurul Huda, Awami League leaders Abdur Rahim, Abul Hossain and Siddique Ali were also killed, and over 100 party activists injured in the attack.
That very night, the then general secretary of the Habiganj Awami League unit, Abdul Majid Khan had filed two cases over the attacks – one for the killings and the other under the Explosives Act.
The first investigating officer, the CID’s ASP Munshi Atiqur Rahman, pressed charges against 10 people on Mar 20 the same year.
On May 3 the following year, the plaintiff objected to the charge sheet at the Sylhet Speedy Trial Tribunal but the court rejected his plea.
He, on May 14, moved the High Court, which issued a rule, asking why the incident should not be investigated further.
The government moved the Appellate Division for a hearing on the High Court order four days later but the appeal was turned down.
However, the CID’s ASP Rafiqul Islam was asked to probe further during the Fakhruddin Ahmed-led caretaker regime.
Islam accused 14 people, including former state minister for home Lutfozzaman Babar and Harkat-ul-Jihad-al-Islami, Bangladesh leader Mufti Hannan, in his charge sheet submitted on June 20, 2011.
But Kibria’s wife Asma Kibria filed an objection to the charge sheet eight days later at the Habiganj court.
On Jan 5, the following year, Sylhet’s Speedy Trial Tribunal accepted the objection and ASP Parul was made the third investigation officer to conduct further investigation.
Apart from naming 11 new people in the third charge sheet, the investigation officer had also recommended dropping three of the accused, as two of them had no address and the other had died. – bdnews24.com
