HC confirms death penalty of 15 in N’ganj 7-murder


Dhaka, Aug 22 – The High Court on Tuesday upheld the death sentence of 15 convicts, including Nur Hossain and 3 Rab officials, and commuted the penalty of 11 others to life term jail in the sensational Narayanganj seven-murder cases.The court also upheld various jail terms of nine others in the cases.
An HC bench comprising Justice Bhabani Prasad Singha and Justice Mustafa Zaman Islam delivered the verdict in the afternoon on the death references and appeals of 26 death-row convicts.
Those awarded the death penalty are former Awami League leader Nur Hossain, commanding officer of Rab-11 in Narayanganj Lt Col Tareque Sayeed Mohammad, then company commander of Rab-11 Major Arif Hossain and Lt Commander Masud Rana, Havildars Enamul Haque, AB Md Arif Hossain, Lance naiks Hira Mia, Belal Hossain, soldiers Abu Tayeb Ali, Abdul Alim, Alamin, constable Md Shihab uddin, SI Purnendu Bala, Mohiuddin Munshi and Tazul Islam.
The lifers are soldiers Asaduzzaman Nur, Ali Mohammad, Mizanur Rahman Dipu, Raham Ali, Abul Basar, Mortuza Jaman Charchil, Selim, Sanaullah Sana, Sah Jahan, Jamal Sardar and Enamul Kabir.
Besides, Lance Naik Ruhul Amin, soldier Nuruzzaman, constable Babul Hasan, ASI Abul Kalam Azad, ASI Kamal Hossain, Moklesur Rahman, constable Habibur Rahamn were sentenced to 10 years imprisonment each and ASI Bazlu Rahman and soldier Nasir Uddin to 7 years each .
The High Court was scheduled to deliver the verdict on August 13, but it changed the date and fixed today (Tuesday) for delivering the verdict.
The HC started hearing on the death reference and appeals on May 22, filed by the 26 condemned convicts in the two cases.
The paper book and all documents related to the murder cases were sent to the High Court on May 7.
A court of Narayanganj on January 16 last sentenced 26 people, including three sacked Rab officials and ex-city councillor Nur Hossain, to death and nine others to different jail terms in the two cases filed over the murder incident.
On April 27, 2014, Narayanganj panel mayor Nazrul Islam, his three associates and driver were abducted from Fatullah area of Narayanganj.
At the same time, senior lawyer at the District Judge’s Court Chandan Kumar Sarkar and his driver were abducted on their way to the capital.
Three days after their abduction, the bodies of six of them, including Nazrul and Chandan, were recovered from the Shitalakhya River.
The following day, the body of Nazrul’s car driver Jahangir was recovered from the river.
Later, Selina Islam Beauty, the widow of Nazrul Islam, filed a case against six people while Advocate Chandan Sarkar’s son-in-law filed the other case.
Expressing his satisfaction over the judgment, Attorney General Mahbubey Alam on Tuesday described the punishment as exemplary one.
“The High Court upheld the death sentence of 15 convicts, including Nur Hossain and three Rab officials, and commuted that of 11 others to life term. The HC also upheld the punishment awarded by the lower to nine other convicts. Certainly, this is an exemplary punishment,” he said while talking to reporters after the judgment.
About the HC observations, the chief state law officer said the court described Rapid Action Battalion (Rab) as an elite force which is working to protect people’s lives and property. “The entire force can’t be blamed for the misdeed of a section,” he said citing the observations.
Asked whether any appeal will be filed against the reduction of the death penalty of 11, he said decision will be taken after getting the copy of the verdict.
Meanwhile, expressing their satisfaction over the verdict, family members of the victims demanded its quick execution.
Selina Islam Beauty, wife of slain panel mayor of Narayanganj City Corporation Nazrul Islam, said, “We got justice. Now, we demand quick execution of the verdict.”
She, however, said they are in fear as the associates of Nur Hossain were not given death penalty.
Chandan Kumar’s daughter Sejuti Paul and son-in-law Bijoy Paul also echoed Beauty.
On the other hand, many locals in Siddhirganj distributed sweetmeats following the verdict while Nur Hossain’s brother Nur Uddin said the High Court upheld the punishment because of the media. – UNB
