High Court limits use of bar fetters in prisons

Fetters can only be used for top terrorist, militants

Fetters can not be used for any accused, except top terrorists, militants and violent convicts, according to the High Court order on Tuesday.

A writ was filed on January 16 seeking an HC directive to stop the mass use of fetters at all jails.

On January 13, accused Patuakhali's Mirzaganj Jatiyatabadi Chhatra Dal (JCD) leader Md Nazmul Mridha took part in his father's namaj-e-janaza cuffed and fettered. Though his handcuffs were opened during the namaj-e-janaza, his fetters were not opened by police.

Barrister Kayser Kamal brought the matter to the High Court's attention. Then the HC advised for a writ.

A two-member HC bench of Justice Mostafa Jaman Islam and Justice Mohammad Atabullah passed the order today after holding hearing of the writ.
