Chattogram Metropolitan Sessions Judge Md. Saiful Islam delivered the decision following a hearing under tight security measures both inside and around the court premises today.
The bail petition was filed by Supreme Court lawyers from the Ainjibi Oikkya Parishad, led by advocate Apurba Kumar Bhattacharjee, who also holds a leadership position within the SSJJ.
Public Prosecutor Md. Mofizul Haque Bhuiyan confirmed the rejection of the bail request to BSS.
Deputy Commissioner (Prosecution) of Chattogram Metropolitan Police, A. A. M. Humayun Kabir, emphasized the heightened security around the court to prevent any disturbances during the proceedings.
Advocate Nazim Uddin Chowdhury, President of the Chattogram District Bar Association, informed the press that Chinmoy’s defense team argued for his release, claiming that their client had not violated any provisions of the sedition law.
In contrast, the prosecution opposed the bail, pointing out the severity of the charges. They reminded the court that individuals accused of sedition could face life imprisonment, making Chinmoy ineligible for bail at this stage of the investigation.
Following the rejection, Chinmoy's lawyer, advocate Apurba Kumar Bhattacharjee, announced plans to appeal to the High Court.
Chinmoy, along with 18 others, is accused in a sedition case filed by Kotowali police on October 31, 2024, for allegedly desecrating the national flag. He was arrested by detectives at Dhaka Shahjalal International Airport on November 25 and transferred to Chattogram Metropolitan Police the next day.
Violence erupted following the rejection of Chinmoy's first bail petition on November 26, when his supporters clashed with law enforcement. Protesters also vandalized court premises and attacked lawyers, with one brutal assault resulting in the murder of advocate Saiful Islam Alif, a promising Supreme Court lawyer.
A second bail petition was submitted on December 3, 2024, but no lawyer appeared to represent Chinmoy. The court then postponed the hearing to January 2, 2025.
